The system in England and Wales is discretionary meaning that the Judge will decide how your finances are split based upon your individual circumstances. As this can be quite unpredictable, many couples choose to decide on their own or be negotiation/mediation and can ask the Court to approve this.
A Court’s decision will always start with consideration of the welfare of any children involved. After that, the Court will consider other factors that help it to determine a fair outcome. Once we have received details of your individual circumstances we will be able to provide you with specific advice.
If you are separating you should consider creating a new Will to reflect your change in circumstance.
